Neo-Nazi Joel Davis was exiled from the National Socialist Network for bringing the organisation into “public disrepute” over a comment encouraging his supporters to “rhetorically rape” a federal MP, a court was told. Mr Davis, a former high-ranking member of the National Socialist Network (NSN), is accused of harassing Allegra Spender using a carriage service following her condemnation of a controversial rally outside state parliament where 60 members of the group gathered last year. Mr Davis has admitted to stating “Patriots, I bid thee to rhetorically rape Allegra Spender” in a message on Telegram, which was then shared on social media and went viral, a court was told. He will be freed from custody after winning a bail application in the NSW Supreme Court on Thursday, with the court told of how Mr Davis was exiled from the NSN as other members were “not impressed” by the “rape” comment. “When he was told not to ‘rape post’, the applicant responded ‘the whole point is to be provocative’,” Justice Natalie Adams told the court on Thursday. The NSW state leader of the NSN Jack Eltis told Mr Davis he would be removed from the group for six months for “bringing the organisation into public disrepute”, the court was told. Mr Davis is expected to defend his case in front of a jury trial, though he has not yet entered any pleas. He is facing a single charge of using a carriage service to menace/harass/offend relating to the comment about Ms Spender, but Justice Adams also said he was hit with nine further charges in March 2026. These were not read out in court and it is currently unclear what these charges are. He is also accused of commenting “stupid b**** needs to be beaten fr (for real)” regarding an article about NSW Liberal leader Kellie Sloane. He is barred from going within 100m of Ms Spender and Ms Sloane, their electoral offices, and also from contacting them as per his bail conditions. Neo-Nazi’s alleged yarmulke ‘game’ comment He has also been barred from living in Bondi, with Justice Adams citing a conversation on Telegram during which Mr Davis allegedly said he had been “playing a game” by pinching yarmulkes from Jewish people and running away. It is unclear whether he actually did this, Justice Adams said. Mr Davis also allegedly referred to being in Bondi as “engaging with the enemy”, she said. He will be able to walk free from Long Bay prison on Thursday after Justice Adams ultimately ruled a myriad of bail conditions could help the Crown’s concerns he could commit a serious offence and endanger the safety of the community if released. He is barred from using social media as part of the conditions and must seek treatment for mental health, and participate in a positive lifestyle program run through the NSW Court chaplain’s association. Neo-Nazi’s shock shower claim Mr Davis “has gone as long as four days without being provided with a shower”, his solicitor claimed in an affidavit tendered to the court. Justice Adams also said he had not been allowed outside since Christmas Eve as his “suspected political affiliations” meant he was kept segregated from other inmates. Mr De Brennan claimed his client had indicated he had changed some of his political views and now just wants to focus on being a father, having missed the birth of his child due to being in custody. A psychologist assessed him as posing a low risk to the community in a report tendered to the court. “He struck me as a person who was at the precipice of change, a man whose focus was more about his family … as opposed to a man who has been seen in demonstrations,” the psychologist wrote in his report. Mr Davis’ bail victory follows his three failed attempts to be released from prison in the local court since his arrest by the Australian Federal Police in November. He claimed during his latest failed bail application in January that he was no longer an NSN member just days after the group announced it would shut down, with Justice Adams confirming this in court on Thursday. Neo-Nazi’s ‘friend’ pushes for his release Mr Davis was beamed into the court from Long Bay jail, with a small group of his supporters gathering outside the courtroom during proceedings. Someone claiming to be a friend of Mr Davis also tried to obtain a videolink to Thursday’s proceedings, a move declined by Justice Adams who said they could have “come to court to watch”. She told the court how another person claiming to be Mr Davis’s friend had a few weeks ago put in a habeas corpus application, a legal tool that requires courts to release a prisoner if they find they have been illegally detained.
