A Vietnamese man who assaulted a six-year-old boy by slapping him on the buttocks in the Albany Leisure and Aquatic Centre changeroom has been handed a significant fine.

Quang Tan Le was fined $1800 in Albany Magistrate’s Court last Thursday after pleading guilty to aggravated common assault.

Sergeant Alan Dean told the court Le was leaving the changeroom when he approached the victim, who was with his seven-year-old brother, and slapped him on the bare buttocks.

Defence counsel Bruno Illari said Le did not intend to be violent to the child and simply wanted to show he approved of him learning to swim when he said “good boy” and gave the thumbs up as he left the change room.

Mr Illari said Le’s actions were not seen as “culturally” inappropriate in Vietnam and applied for a spent conviction which was not granted.

Sgt Dean accepted there was no malice but Le had caused some distress for the victim.
