Commercial fisherman will go to trial over gummy shark fillets seized in Walpole

A trial date has been set for a commercial fisherman to defend allegations he sold a protected species of shark to a Walpole cafe — nearly three years after the alleged offence. Bryan John Sell is accused of selling just over 10kg of gummy shark fillets — a category one protected species — to the cafe in April 2018, the Albany Magistrate’s Court was told by public prosecutor Gemma Mullins in July. If found guilty, Mr Sell will be at risk of having his fishing licence stripped by the Department of Primary Industries and Regional Development. According to Ms Mullins, Mr Sell was put in contact with the cafe by a third party before selling the fillets for $100 on April 12, 2018. The fillets were allegedly found the next day by authorities when they inspected the cafe’s freezers. Mr Sell also allegedly lied to the DPIRD in his monthly catch record in June 2018. Mr Sell’s defence counsel Bruno Illari made admissions in August that his client had sold fish fillets to the cafe. “What is disputed is that he sold fish he was entitled to sell, not gummy shark,” Mr Illari said. Mr Illari argued the fish sold to the cafe were not the fillets — identified as gummy shark by DNA analysis — seized by authorities on April 13, 2018. In court last Thursday, a two-day trial was set for February 1 and 2. Mr Illari told the court no more concession of the facts could be made to shorten the trial’s length. He said witnesses’ evidence would likely only take a day to be heard by Magistrate Raelene Johnston, but told the court the hearing would likely have to spill into a second day so he and the State could submit their closing statements. Ms Johnston had to backdate her preferred trial date of December because a key State witness would be unavailable. Ms Johnston said the February trial was “not ideal for the court”. Under WA law, shark can only be bought or sold commercially in accordance with a managed fishery licence. All sharks are commercially protected, allowing only a few commercial fishers to keep their shark catches for sale. White sharks, whale sharks, northern river sharks, speartooth sharks and all sawfish are protected from all fishing.
